question or a remote-work preference.\u00a0For a defined set of roles, it is a compliance, tax, and\u00a0data-sovereignty\u00a0question \u2014 and it needs to be confirmed, not assumed.<\/em>\u00a0<\/em><\/p>\n<\/blockquote>\n\n\n\n<h2 class=\"wp-block-heading\"><strong><strong><strong>The scenario that should worry you<\/strong>\u00a0<\/strong><\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A contractor is hired for a role that requires work to be performed inside a specific\u00a0jurisdiction\u00a0\u2014 for data residency, export control, or client-contract reasons. They confirm the\u00a0location\u00a0at\u00a0onboarding. The work is good. Everyone moves on.\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Months later, an access log review shows\u00a0logins\u00a0from a country no one approved. The work was being performed from outside the permitted\u00a0jurisdiction\u00a0the entire time. Now the question is not performance \u2014 it is whether the organization has been in breach of a client contract, a data-protection regulation, or an export-control rule for the length of the engagement.\u00a0<\/p>\n\n\n\n<div class=\"wp-block-group is-layout-constrained wp-block-group-is-layout-constrained\" style=\"margin-bottom:var(--wp--preset--spacing--50)\">\n<h2 class=\"wp-block-heading\"><strong><strong><strong>Why location is a control, not a preference<\/strong>\u00a0<\/strong>\u00a0<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">For most roles, where someone works is genuinely a matter of preference and flexibility. For a specific subset, it\u00a0determines\u00a0which laws apply. Location drives payroll tax obligations. It\u00a0determines\u00a0whether GDPR or HIPAA governs the data being touched. It decides whether ITAR or export-control rules are being violated. A worker accessing EU-citizen data from a non-approved country creates a violation regardless of whether the employer knew.\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The infrastructure for hiding\u00a0location\u00a0has matured.\u00a0Laptop farms let a worker appear locally based while operating overseas.\u00a0Residential proxy networks route traffic through genuine in-country IP addresses. Passive trust \u2014 taking the stated location at face value \u2014 is no longer a control.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong><strong><strong><strong>Where the risk concentrates<\/strong><\/strong><\/strong>\u00a0<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The roles that matter are identifiable in advance:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Roles touching regulated data \u2014 health, financial, or personal data subject to residency rules.\u00a0<\/li>\n\n\n\n<li>Roles under client contracts that specify where work may be performed.\u00a0<\/li>\n\n\n\n<li>Roles subject to export-control or sovereignty requirements, where a\u00a0location\u00a0violation is a criminal-liability question.\u00a0<\/li>\n\n\n\n<li>Roles with privileged system access, where an unverified location compounds every other access risk.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong><strong><strong>Start here<\/strong><\/strong>\u00a0<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Identify\u00a0the roles where location is a compliance variable, not a preference. For those roles, confirm location actively \u2014 IP and geolocation\u00a0checks\u00a0against the stated work location, not a one-time attestation at onboarding \u2014 and re-confirm it on a schedule, because a location that was\u00a0accurate\u00a0on day one can change without notice.\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For everything else, leave the flexibility in place. The goal is not to\u00a0surveil\u00a0every contractor.
